Terms of use and sale
1. Purpose
These terms govern the use of Retakly, published by NOVA, a service to record, edit, host and share screen and camera videos.
2. Account
You sign in with a login link sent by email or with a Google account. You are responsible for access to your mailbox and for actions taken from your account.
3. Plans, prices and payment
The service is offered as a free plan and as paid monthly or yearly subscriptions described on the Pricing page.
Subscriptions renew automatically and are paid in advance through Stripe. Purchased credits are only used beyond your plan's quotas and can be capped by the workspace admin.
Unlimited videos and storage on paid plans cover normal professional use. Above 1 TB stored per user, or in case of clearly unrelated use (file hosting unrelated to the service, mass distribution), we may contact you to agree on a solution: archiving, export or a suitable plan. We never delete a video without notice.
4. Cancellation
You can cancel at any time from the Plan and usage page. Cancellation takes effect at the end of the paid period. When you return to the free plan, if your videos exceed its limits (10 videos and 3 GB), you have 30 days to choose the ones to keep and download the others. At the end of this period, extra videos are permanently deleted: the ones you marked are kept first, then the most recent. You are notified by email when the period starts, 7 days before it ends and the day before. If you subscribe again before the deadline, nothing is deleted.
5. Right of withdrawal
Consumers have a 14-day right of withdrawal. By requesting immediate access to the service, you acknowledge that performance starts before this period ends. The service is mainly intended for professionals; this right does not apply to customers acting for business purposes.
6. Content
You keep ownership of your videos and only grant us the rights needed to host, process (conversion, transcription, requested AI features) and deliver them according to your sharing settings.
Illegal content, content infringing third-party rights, or recordings of people made unlawfully without their knowledge are forbidden. Reported content may be removed, with a statement of reasons, in line with the EU Digital Services Act.
7. Artificial intelligence features
AI features (summary, chapters, tutorial, and later voice and dubbing) only run when you ask for them. AI-generated content is labelled as such. You remain responsible for checking it before publishing.
8. Availability and liability
We use reasonable means to keep the service available and backed up, without guarantee of result. Our liability is limited to the amount paid over the last twelve months, except in case of gross negligence or wilful misconduct.
9. Personal data
Data processing is described in the privacy policy and, for our business customers' videos, in the data processing agreement.
10. Governing law
These terms are governed by French law. Failing an amicable settlement, disputes are brought before the Commercial Court of Antibes (France), subject to consumer protection rules.
